US Judge Mandates Freedom of Abrego Garcia from ICE Custody
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.
The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to answer alien smuggling charges, he was held in immigration custody.
In her order, the judge pointed out that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
Context of the Case
The court proceedings involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.
Conditions of Release
The judge, who was overseeing his challenge to deportation in a federal court, determined that he must now comply with the terms of his bond from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This ruling represents a notable turn in a complex legal case involving claims of mistaken imprisonment and disputed gang affiliations.
